An Accra High Court has dismissed the National Democratic Congress’ (NDC) preliminary objection challenging the jurisdiction to hear the New Patriotic Party’s (NPP) mandamus application.
According to Myjoyonline on Wednesday, January 1, 2025, The NPP had filed the application seeking to compel the Electoral Commission (EC) to re-collate parliamentary election results from four contested constituencies: Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.
The NDC argued that the NPP’s application was essentially an election petition in disguise, contending that once election results have been declared, a mandamus order is not applicable.
They further asserted that the court should not entertain the matter.
However, the presiding judge rejected the objection, affirming that the court’s jurisdiction had been correctly invoked.
The judge emphasized that judicial review proceedings were essential to ensure the EC’s actions aligned with the law and legal processes.
With the dismissal of the objection, the court is now set to proceed with the substantive mandamus application.
The NPP has expressed concerns over alleged irregularities during the initial collation of results and seeks the court’s intervention to compel the EC to re-collate the results in the four constituencies.
On the other hand, the NDC insists that the results in question have already been declared, and there is no legal basis for further action.
The case now awaits further deliberations as both parties prepare for the next phase of legal proceedings.
