Lagos— A N1.8 million suit has been instituted against an Assistant Superintendent of Police, ASP, Mr. Christian Alabaraonye, and one Mr. Uchenna Agbowo, over alleged breach of contract to deliver a container on the stipulated time.
In the suit before a Federal High Court sitting in Lagos, the plaintiff, Cargo Koncepts Limited, accused the defendants of delaying the delivery of the container meant to be transported from Lagos port to Abuja, as agreed by parties.
The plaintiff is asking the court to order the defendants, jointly and severally to pay “the sum of N705,600, being demurrages incurred by the plaintiff for 42 days, from March 22, to May 2, 2011, on the container due to delay by the defendants to bring their truck to transport the said container out of the port terminal and deliver the content at Abuja as agreed by the parties.”
Cargo Koncepts is also asking the court to grant it N1 million as general damages for breach of contract for failing to carry the container “out of the port terminal, after the plaintiff had paid the defendants for the services, which breach caused the plaintiff to disappoint its clients.”
The plaintiff averred that before paying the sum of N560,000 to the defendants for the haulage services, it requested the defendants to convince it that they had the trucks and they produced the purchase receipts of the vehicles and pictures of the trucks, adding that the container arrived the Apapa port on March 18, and the defendants were notified immediately. But that the defendants made unfulfilled promises from March 22, 2011 to bring the vehicles but failed.
