BENIN—A Federal High Court sitting in Benin, Edo State, has awarded the sum of N10million to one Lucky Etomokwu, a physically challenged, as general damages for his unlawful arrest and detention by the Edo State Command of the State Security Services, SSS.

Mr. Etumokwu was arrested by SSS operatives on May 26, 2010 at his business centre on Sapele Road, Benin for allegedly being a member of a kidnap gang which  kidnapped one Dr, Osaro Osifo.

Trial judge is Justice Adamu Hobon. The applicant, following his release from detention, dragged the SSS to court, for gross violation of his rights to personal liberty and freedom of movement as guaranteed under Section 35 and 41 of the 1999 constitution and Article 6 and 12 of African Charter on Human and Peoples’ Rights.

He had urged the court to declare  his arrest and detention by SSS operatives from May 26,  till 28, 2010, as a violation of his fundamental human rights and demanded N50million as general and exemplary damages for the unlawful and unconstitutional arrest.
Justice Hobon in his judgement, noted that there was no evidence linking the applicant with the kidnap of Dr. Osifo, adding that his arrest, shooting, detention, handcuffing by the SSS was based merely on suspicion.
