Kampala — The Constitutional Court is set to give its ruling this morning on whether to halt or allow the Chogm proceedings against former Vice President Gilbert Bukenya now before the Anti-Corruption Court.
The ruling is expected to be delivered by the Registrar Court of Appeal, Mr Erias Kisawuzi, on behalf of three Court of Appeal justices led by the Deputy Chief Justice Alice E. Mpagi-Bahigeine at 10am. “Take notice that the ruling has been fixed for June 29 at 10am,” the notice read in part.
No two ways
However, the registrar has warned the parties involved in this case to appear or be represented because the ruling has to go on whether with or without their representation in court. The parties served with the notice include; the lawyers of Prof. Bukenya, the Attorney General – who is the respondent in this case, the IGG and Victoria Advocates legal consultants.
Last week, Bukenya filed a petition before the Constitutional Court seeking its powers to block the IGG from prosecuting him before the Anti-Corruption Court. He said his actions during the purchase of the 2007 Chogm vehicles were undertaken on behalf of the President who is immune to prosecution. He is jointly charged with Motorcare (U) Ltd, the company that supplied of the 204 executive vehicles.
