An old man of about 70 years of age testifies in lawyer Mboge’s alleged fraud case at the Banjul High Court on 24 May 2011.
Alagie Kalifa Barrow said he lives at Jambanjelly and his occupation is farming. He was asked who Saidou Barrow is; he said Saidou is his son.
He was asked to look at Lawyer Mboge and say if he knows him; he said he knows him. Asked if there is anything that transpires between them; he explains that since he was involved in a land case 20 years back, they could not get their land back, he said the accused person was recommended to them to take him as a counsel to pursue the case.
Mr. Barrow said he took Mboge as his counsel who is the accused person now and told him that there is no need for a fresh case in court for this matter; that all that is required is to get an officer to go and locate the person in the compound. This is what transpires between him and Mboge and added that the Attorney General knows about it since he was the one who directed us to the accused person and asked us to give him something to him.
Asked if he knows the person who thumps print on a document shown to him, the old man said: “I don’t know the thumbprint of this person because I cannot read”.
Cross examination by Lawyer L. Mboge
Mr. Mboge asked Mr. Kalifa whether he has another name different from Kalifa? I have other names but my official name is Kalifa Barrow. Asked whether he is also called Muhammed Barrow? If you hear the name Muhammed, it means Kalifa.
Mboge asked: How old are you now? Kalifa said: My name and date are in my passport but when i was going to Mecca I was 29 + the 44 years now from that time.
Asked how long ago was his judgment in his land case? Kalifa said: Is more than 20 something years now.
Mboge asked why you failed to execute the judgment until 2010.
Kalifa said: “I was following Antouman Gaye every month but he did not do anything about it”.
He was asked if his son told him that he meets him (Mboge) before going to the Attorney General. Kalifa said he is not aware of that.
“You remember that I told you will take my advice before taking your case and I did not discuss anything unless the occupant gives way”, said Mboge. My second condition was when you pay me the cost I will take your case? Yes, said the old man.
“Do you know why I said if your take my advice?” asked Mboge.
The case is adjourned to 1st June 2011.
